Terms of Service

These Terms of Service explain the rules for using deliving.co.uk and purchasing products from DELIVING.

By visiting our website, browsing our products, creating an account or placing an order, you agree to these Terms of Service, together with our Shipping & Delivery Policy, Returns & Refunds Policy and Privacy Policy.

If you do not agree with these terms, please do not use our website or place an order.

Important: Nothing in these Terms of Service affects your statutory rights as a consumer under applicable UK consumer law.

2. Using our website

You agree to use our website only for lawful purposes and in a way that does not damage, disable, overload or interfere with our website, our business, our customers or any third party.

You must not use our website:

  • for any unlawful, fraudulent or harmful purpose;
  • to transmit viruses, malware or harmful code;
  • to copy, scrape, reproduce or misuse website content without permission;
  • to interfere with website security, checkout, payments or functionality;
  • to provide false, misleading or inaccurate information;
  • to attempt to gain unauthorised access to any part of our website, systems or accounts.

3. Product information

We aim to display product information, images, descriptions, prices, measurements, materials, colours, finishes and availability as accurately as possible.

However, product colours, finishes and textures may appear slightly different on your screen depending on your device, display settings, lighting and photography.

Furniture measurements are usually approximate. Small variations may occur because of product design, manufacturing tolerances, natural materials or supplier information.

We may update, correct, change or remove product information at any time if we discover an error, supplier change, stock issue, pricing issue or product availability issue.

4. Orders

When you place an order, you are making an offer to buy the product or products in your basket.

Your order is not accepted until we confirm it and begin processing it. We may refuse, cancel or refund an order if:

  • the product is unavailable;
  • there is an error in the price, delivery charge or product information;
  • delivery is not available to your address;
  • an additional delivery charge applies and is not accepted;
  • we suspect fraud, misuse or incorrect information;
  • we are unable to process payment;
  • the order cannot be fulfilled due to supplier, courier or stock availability issues.

If we cancel an order before dispatch, we will refund any payment taken for that order.

5. Prices and payment

All prices are shown in pounds sterling (£/GBP).

Prices may include applicable taxes where shown on the product page or at checkout. Delivery options and any applicable delivery charges will be shown at checkout where available, or confirmed before dispatch where a custom delivery quote is required.

Prices, discounts, promotions and product availability may change at any time without notice.

You agree to provide current, complete and accurate billing, payment and delivery information when placing an order.

If we identify a pricing error after you place an order, we may contact you to confirm whether you wish to proceed at the correct price or cancel the order for a refund.

6. Delivery

Delivery availability, estimated delivery times and delivery charges may vary depending on the product, item size, delivery postcode, courier access and supplier dispatch availability.

Some products include standard mainland delivery in the product price. Other products or delivery locations may require an additional delivery charge, which may be shown at checkout or confirmed before dispatch.

Please read our Shipping & Delivery Policy before placing an order.

Delivery times are estimates only. We are not responsible for delays caused by courier delays, supplier processing delays, warehouse delays, weather, access restrictions, incorrect delivery information or other circumstances outside our reasonable control.

Risk in the goods passes to you when the goods are delivered to you, or to a person you have authorised to receive them.

7. Cancellations, returns and refunds

Your cancellation, return and refund rights are explained in our Returns & Refunds Policy.

For most online purchases, UK consumers have the right to tell us that they wish to cancel within 14 days after receiving the goods. Some exceptions may apply, for example for personalised, made-to-order or specially customised products.

If your order has already been dispatched, collected by a courier, prepared for delivery, moved from a supplier warehouse, transferred to a delivery partner or prepared for final delivery, cancellation may no longer be free.

In this case, a cancellation, return, collection or handling cost may apply. The exact amount depends on the item size, courier charges, supplier charges, return transport costs and order status.

Please contact us before refusing delivery or requesting cancellation after dispatch. Refusing delivery without contacting us first may cause additional return, storage, redelivery or cancellation charges.

Nothing in these Terms of Service limits your statutory rights.

8. Damaged, faulty or incorrect items

Please inspect your order as soon as it arrives.

If your item arrives damaged, faulty, incorrect or incomplete, please contact us as soon as possible with your order number, a description of the issue and clear photos of the product and packaging.

We will review the issue and explain the next steps. This may include a replacement part, repair, replacement item, collection, refund or another suitable resolution depending on the circumstances.

9. Product availability

Products may be supplied directly or indirectly through supplier partners, warehouses, courier networks or fulfilment partners.

Stock availability can change quickly. If a product becomes unavailable after you place an order, we will contact you and offer a suitable solution where possible, such as waiting for restock, choosing an alternative product or receiving a refund.

10. Accounts

You may be able to create an account on our website. You are responsible for keeping your account login details secure and for all activity under your account.

You must provide accurate and up-to-date account information. If you believe your account has been used without permission, please contact us.

11. Intellectual property

You may use our website for personal shopping and browsing only. You must not copy, reproduce, distribute, modify, scrape, republish or commercially use our website content without our prior written permission.

12. Third-party services and links

Our website may include links to third-party websites, tools, payment providers, apps or services.

We are not responsible for third-party websites or services. If you use a third-party website or service, you should read their own terms and privacy policy.

13. Shopify

Our store is powered by Shopify, which provides the ecommerce platform that allows us to sell products to you.

Any purchase you make through our store is made directly with DELIVING. Shopify is not responsible for the products we sell, delivery, returns, refunds or customer service relating to your order.

14. Privacy

How we collect, use and protect your personal information is explained in our Privacy Policy.

By using our website or placing an order, you acknowledge that we will process your personal information as necessary to provide our services, process orders, arrange delivery, communicate with you and meet legal or business obligations.

15. Reviews, feedback and user content

If you submit reviews, feedback, photos, comments or other content to us, you confirm that the content is accurate, lawful and does not infringe the rights of any third party.

You allow us to use, display, reproduce and share that content for business, marketing, customer service and website purposes, unless you tell us otherwise and we are legally required to remove it.

We may remove content that we consider unlawful, offensive, misleading, abusive, spam-like or otherwise inappropriate.

16. Errors and inaccuracies

Occasionally, our website may contain typographical errors, pricing errors, stock errors, product description errors, delivery charge errors, transit time errors or other inaccuracies.

We reserve the right to correct errors, update information, cancel orders or refuse orders where information is inaccurate, including after an order has been placed.

17. Limitation of liability

We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or breach of your statutory rights.

Subject to the above, we are not responsible for indirect, incidental or consequential losses, loss of profit, loss of business, loss of opportunity or loss of data arising from your use of our website or purchase of products.

Our total liability to you for any order will not exceed the amount paid by you for that order, except where the law does not allow us to limit liability.

18. Events outside our control

We are not responsible for failure or delay in performing our obligations where this is caused by events outside our reasonable control.

This may include courier delays, supplier delays, warehouse delays, transport disruption, strikes, extreme weather, accidents, fire, flood, technical failures, cyber incidents, government restrictions or other events beyond our control.

19. Changes to these Terms

We may update these Terms of Service from time to time. The latest version will be available on this page.

Changes will apply from the date they are posted on our website. Your continued use of the website after changes are posted means you accept the updated terms.

20. Governing law

These Terms of Service are governed by the laws of England and Wales.

If you are a consumer, you may have additional rights to bring claims in your local courts depending on where you live.
